Let us Look at these design which have been examined by OHIM:
The opponent claimed that the RCD was invalidated by the publication of a prior design.
The invalidity division of OHIM, however, disagreed. The two opposing designs are almost identical, saved the flashing feature throwing a soft blue light invisible, shown in one of the tree views of RCD, as above reported, and that has been reputed as enough as to mark the substantial difference between the two radiators , in spite of the immateriality of the figured feature.
